Photographs taken by Luminous Lens Studio remain the intellectual property of Luminous Lens Studio. The client receives a license to use the photographs for personal use. Commercial use of the photographs requires a separate agreement and additional fees.

4. Photography Services Agreement

Engaging Luminous Lens Studio for photography services constitutes acceptance of the following terms:

4.1. Booking and Payment

A non-refundable deposit is required to secure a booking for photography services. The remaining balance is due as specified in the service agreement or invoice. Luminous Lens Studio reserves the right to cancel the booking if payment is not received on time.

4.2. Cancellation and Rescheduling

In the event of cancellation by the client, the deposit is non-refundable. Rescheduling is subject to availability and may incur additional fees. Luminous Lens Studio reserves the right to cancel or reschedule a shoot due to unforeseen circumstances, such as illness or inclement weather. In such cases, the client will receive a full refund of any payments made.

4.3. Image Delivery

Digital images will be delivered to the client via an online gallery or other agreed-upon method. Luminous Lens Studio is not responsible for the loss or damage of digital images after they have been delivered to the client. The timeframe for image delivery will be specified in the service agreement.

4.4. Usage Rights

The client is granted a personal use license for the photographs taken by Luminous Lens Studio. This license allows the client to print, share, and display the photographs for personal, non-commercial purposes. Commercial use of the photographs requires a separate agreement and additional fees.

4.5. Model Release

The client is responsible for obtaining model releases from all individuals photographed during the session. Luminous Lens Studio is not responsible for any legal issues arising from the lack of a model release.

5. Limitation of Liability

Luminous Lens Studio will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your access to or use of the website or our services. This includes, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the website or our services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from our website; (iv) any bugs, viruses, trojan horses, or the like which may be transmitted to or through our website by any third party; or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the website or our services.

These terms and conditions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms and conditions shall be brought exclusively in the federal or state courts located in Cook County, Illinois, and you consent to the personal jurisdiction of such courts.

Luminous Lens Studio reserves the right to modify these terms and conditions at any time without prior notice. Your continued use of the website and our services following any changes constitutes your acceptance of the new terms and conditions.
